Rep. Luanne Van Werven discusses the implications of the state Supreme Court's “Hirst decision.” The court ruled Whatcom County's comprehensive plan failed to adequately protect water resources as directed under the Growth Management Act.

The ruling also put the status of household wells into question even though Whatcom County complied with Department of Ecology's rules that allows the permitting of wells if homeowners use fewer than 5,000 gallons of water per day. These wells are considered “exempt.”
